Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using the WireWolf platform, website, software, APIs, or any related services (collectively, the "Services") provided by WireWolf, Inc. ("WireWolf," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease all use of our Services.

These Terms constitute a legally binding agreement between you and WireWolf. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Services constitutes acceptance of any modified Terms.

2. Service Description

WireWolf provides an autonomous AI-powered penetration testing platform designed to identify security vulnerabilities in computer systems, networks, and applications. Our Services include, but are not limited to:

  • Automated vulnerability scanning and assessment
  • AI-driven penetration testing simulations
  • Security reporting and analytics
  • API access for integration purposes
  • Beta testing programs and early access features

Critical Notice

WireWolf's Services are powerful security testing tools. Misuse of these Services may violate federal, state, local, and international laws, including but not limited to the Computer Fraud and Abuse Act (CFAA), and may result in severe civil and criminal penalties.

3. User Eligibility and Account Responsibilities

To use our Services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using security testing tools under applicable law
  • Provide accurate, current, and complete registration information
  • Maintain the security and confidentiality of your account credentials

You are solely responsible for all activities that occur under your account. You agree to immediately notify WireWolf of any unauthorized use of your account or any other breach of security.

4. Authorized Use Only

Mandatory Authorization Requirement

YOU MUST HAVE EXPLICIT, WRITTEN AUTHORIZATION FROM THE OWNER OR AUTHORIZED ADMINISTRATOR OF ANY SYSTEM, NETWORK, OR APPLICATION BEFORE USING WIREWOLF SERVICES TO TEST THAT TARGET. TESTING WITHOUT PROPER AUTHORIZATION IS ILLEGAL AND STRICTLY PROHIBITED.

By using our Services, you represent and warrant that:

  • You own or have obtained explicit written permission from the rightful owner to test any target systems
  • You have documented proof of authorization that can be provided upon request
  • Your testing activities are within the scope of any authorization granted
  • You will comply with all applicable laws, regulations, and contractual obligations
  • You will not test any systems belonging to third parties without their express consent

5. Prohibited Conduct

You agree NOT to use the Services to:

  • Test, scan, probe, or attack any system without proper authorization
  • Engage in any illegal activities, including unauthorized access to computer systems
  • Violate the Computer Fraud and Abuse Act or similar laws in any jurisdiction
  • Conduct denial-of-service attacks or attempt to disrupt any services
  • Access, collect, or store personal data in violation of privacy laws
  • Distribute malware, ransomware, or other malicious code
  • Interfere with or disrupt critical infrastructure systems
  • Test systems of financial institutions, healthcare providers, or government agencies without proper authorization and compliance procedures
  • Resell, redistribute, or sublicense the Services without authorization
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Circumvent or disable any security features of the Services
  • Use the Services for competitive analysis or to develop competing products
  • Engage in any activity that could damage WireWolf's reputation or business

6. Beta Program Terms

If you participate in any beta testing program:

  • Beta features are provided "AS IS" with no warranties of any kind
  • Beta features may be unstable, incomplete, or contain errors
  • WireWolf may modify, suspend, or discontinue beta features at any time without notice
  • You agree to provide feedback and report issues as requested
  • Any feedback you provide becomes WireWolf's property without compensation
  • Beta features may have limited support or no support
  • You agree to maintain confidentiality regarding beta features unless otherwise authorized

7. Intellectual Property

All intellectual property rights in the Services, including but not limited to software, algorithms, AI models, documentation, trademarks, trade secrets, and copyrights, are and shall remain the exclusive property of WireWolf. Nothing in these Terms grants you any right, title, or interest in our intellectual property except for the limited license to use the Services as expressly permitted herein.

You retain ownership of any data you provide to the Services, but you grant WireWolf a non-exclusive, worldwide, royalty-free license to use, process, and analyze such data solely for the purpose of providing and improving the Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WIREWOLF, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • System downtime or interruption of services
  • Cost of procurement of substitute services
  • Damages resulting from unauthorized access to your systems or data
  • Damages arising from your use or inability to use the Services
  • Damages resulting from any conduct of third parties
  • Legal fees, penalties, or fines resulting from your misuse of the Services

IN NO EVENT SHALL WIREWOLF'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO WIREWOLF IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, WIREWOLF'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless WireWolf, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your testing of any systems without proper authorization
  • Any claim that your use of the Services caused damage to a third party
  • Your negligence or willful misconduct
  • Any data breach or security incident resulting from your actions

This indemnification obligation shall survive the termination of these Terms and your use of the Services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WIREWOLF SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WIREWOLF DOES NOT WARRANT THAT:

  • The Services will meet your requirements or expectations
  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Services will be accurate or reliable
  • Any vulnerabilities identified (or not identified) will be complete or accurate
  • Any defects in the Services will be corrected

YOU ACKNOWLEDGE THAT SECURITY TESTING IS INHERENTLY IMPERFECT AND THAT NO AUTOMATED TOOL CAN GUARANTEE THE IDENTIFICATION OF ALL VULNERABILITIES OR SECURITY ISSUES.

11. Third-Party Services and Links

The Services may contain links to or integrate with third-party services, websites, or tools. WireWolf does not endorse, control, or assume any responsibility for third-party content or services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

12. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

13. Termination

WireWolf may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected unauthorized or illegal activity
  • Request by law enforcement or government agency
  • Discontinuation or modification of the Services
  • Technical or security issues
  • Non-payment of applicable fees

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, and the arbitrator's decision shall be final and binding.

YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Notwithstanding the foregoing, WireWolf may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

15. Export Compliance

You acknowledge that the Services may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export restrictions and not to transfer or use the Services in violation of any such laws or regulations.

16. Force Majeure

WireWolf shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by WireWolf, constitute the entire agreement between you and WireWolf concerning the Services and supersede all prior or contemporaneous communications and proposals.

BY USING WIREWOLF SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.
